Washington v. Wilmore, the Fourth Circuit in an opinion by Chief Judge Wilkins, joined by Judge Motz, and with Judge Shedd concurring separately, affirmed the denial of qualified immunity to one of the defendants sued by Earl Washington in the W.D. Va. The defendant, now deceased, was an agent of the Virginia State Police.
