U.S. v. Geraci, the Fourth Circuit in a per curiam decision for the panel of Judges Luttig, Niemeyer, and Michael upheld the constitutionality of the 18 U.S.C. 2244(a)(1) as applied to the defendant, rejected her claim that she was entitled to a pre-trial evidentiary hearing on the admissibility of a child's testimony, and rejected the defendant's arguments about the admissibility of hearsay testimony used against her at trial.
