Lawyer blogger's spam case tossed on motion to strike in Fairfax County circuit court

A cover story in this week's Virginia Lawyers Weekly describes a lawsuit brought on behalf of a blogger against an Ohio firm, claiming that the company's spam used the blog's domain name. Plaintiff brought suit under the civil remedy provisions of the Virginia Computer Crimes Act. The defendant convinced the trial court to grant its motion to strike the evidence, by showing that the spam originated from some Russian company that does bulk e-mail, as to which the U.S. defendant had no knowledge or control.
